Immigration Forms

Ok let's get to those forms you need when you apply for a Green Card through marriage.

1. I-130 - Petition for Alien Relative

It is the petition your husband/wife applies for on your behalf. For citizens or lawful permanent residents of the United States to establish the relationship to certain alien relatives who wish to immigrate to the United States. Note: A separate form must be filed for each eligible relative. USCIS processes Form I-130, Petition for Alien Relative, as a visa number becomes available. Filing and approval of an I-130 is only the first step in helping a relative immigrate to the United States. Eligible family members must wait until there is a visa number available before they can apply for an immigrant visa or adjustment of status to a lawful permanent resident. It contains information about the petitioner (your husband/wife) and info about the beneficiary (you). It has to be signed by the petitioner.

Fee: $355

2. I-485 - Application to Register Permanent Residence or Adjusment of Status

If you are in the United States under another type of visa already, like I am on a H1B now, you have to apply for this Adjusment of Status, so your non-immigrant status is "adjusted" to an immigrant status. It basically needs information about you, your past applications, visas and such.

Fee: $930 plus a biometrics fee of $80; total $1010. When your application is accepted and processed, they will let you know when/where you need to go for the biometrics test (they take your fingerprints and/or photos).

3. I-693 - Report of Medical Examination and Vaccination Record

You fill out only the first part. The rest is completed by the Civil Surgeon you need to see for your medical examination. Civil Surgeons are doctors who are appointed by the USCIS to do these examinations. You can do this before all the other documents. NOTE: it is not paid by insurance.

Fee: Depending on if you have any vaccinations already and you can provide proof of them, it costs around $520 (or less). I had to do everything: blood draw, HIV test, 4 vaccines, all other sorts of stuff so I paid the whole thing.
When complete, the results have to be in a sealed envelope that you are not allowed to open. USCIS receives the sealed envelope as is.

6. I-864 - Affidavit of Support under Section 213 of the Act

This form is required for most family-based immigrants and some employment-based immigrants to show that they havea dequate means of financial support and that they are not likely to become a public charge. When your husband/wife files for a Green Card on your behalf (or for form I-130), they become your sponsor. They have to show they have enough income to support you. To qualify as a sponsor, you must demonstrate that your income is at least 125 percent of the current Federal poverty guideline for your household size.
So it contains information about your husband/wife's income, assets etc. Add the W-2 for last year's tax returns.
